The system of rights to the above mentioned types of intellectual property, recognized and protected by law, includes exclusive right that is a property right, and, in instances provided for by law, personal non-property rights and other rights.

Right of authorship, right to name, and other personal non-property rights can only belong to the author – a citizen, by whose creative labour the work was created. Exclusive (property) right to the object of intellectual rights, i.e. right to use such object at the discretion of the right-possesor by any means not contrary to a law arises initially with the author and may be transferred by the latter to another person under a contract, or vest in other persons on other grounds. In instances provided for by law exclusive rights to a result of intellectual property or to means of individualization is recognized and protected subject to state registration thereof.

Violated personal non-property rights and exclusive rights to a results of intellectual activity may be defended by any means provided for by the Civil Code of the RF taking into account the essence of the violated rights and the consequences of the violation thereof.
